  Registering a domain name similar to that of another organization and then using the URL to protest against its namesake's products or services is acceptable, according to the World Intellectual Property Organization.

An arbitrator with World Intellectual Property Organization has awarded the domain name DKB.com to Deutsche Kreditbank AG. The owner of DKB.com, DKB Data Services, had invalid contact information and may have been dissolved — which probably explains why it didn’t respond to the complaint.

Arbitrator John Swinson found that the domain was registered in bad faith because it has not been used:

Mr. William Towns of the Firm NOVAK DRUCE who made the  decision to award Godaddy.com the domain name gotodaddy.com which was registered in 2002 and owned by DomainsNext.com .  At that time no one knew who GoDaddy was.  In the meantime the panelist declined to award GoDaddy the domain names gotodaddynot.com and gotodaddynot.net, since GoDaddy had decided that those two domain names had no economical value   

In the recently decide Deutsche Kreditbank AG v. DKB Data Services (USA), Inc. D2009-1084 (WIPO Sept 30, 2009), the respondent registered a three letter domain name (dkb.com) in 2001.

False Advertising, Bait-and-Switch Scheme

Why is it a bait and switch?  VeriSign charges all registrars including Godaddy $6.86 for every .com that is registered or renewed, plus ICANN fees of $.20.  This is a total of $7.06.  This does not include credit card processing fees, other expenses like salaries, advertisement, + + +.  Is this a real savings to the customers or another $50 billion Ponzi scheme?  Only time will tell.

DomainsNext.com and its sister websites have lost 10s of thousands of domain names and customers to a company called GoDaddy which conspired with many advertisers including Google, ABC and ESPN Sports and Super Bowl advertisements using their false advertising Bait-And-Switch marketing scheme, and false claims of low cost domain name registration and renewal.  The TV ads and Google.com sponsored ads claim that you can get a domain name for $1.99 Incl: Hosting, Email & More Free!.  Look closely under what conditions you can get the $1.99 registration, as their website shows under a hidden click.  GoDaddy has built its portfolio not mainly through attracting new customers, but by stealing other registrars' customers and false advertising.  We would estimate that 40% of its portfolio of a minimum of 27 million domain names have been obtained by luring other registrars' customers and targeting  customers of premier registrars like Network Solutions and Register.com to move their domain names.  We as a small company have suffered substantial losses from this practice, and it is about time this practice is stopped, and the advertiser should take a closer look at the fine print before advertising GoDaddy's claims.

Below is the fine print regarding the conditions for getting a domain name for $1.99.  It is estimated that 90% of those who come because of what the ad said, end up buying a different product for a different price since the total amount paid for the bundle far exceeds registering a domain name for the face value of $10.15, and here comes the bait and switch.
Products must be new to the customer (not currently owned) to qualify. One 1 yr $1.99* .com, .us, .biz, .info, .name, .net, or .org domain per each qualifying product; new, transfer or renewal. Recurring billing charges, existing product, domain renewals, domain backorders, premium domain names and domain registration products (such as Privacy, Business Registration, Express Appraisals, Certified Domain, Domain Ownership Protection and Parking), Gift Cards, photo prints and merchandise, and some "add-on" companion products (such as additional hosting bandwidth and storage) do not qualify as product purchases. I consider your email below as nothing more than harassment and intimidation by you and your company, and you did not fully do your homework prior to sending your email to us.  We have registered the domain name gotodaddy.com on June 15, 2002.   The trademark you are claiming to have did not exist at the time of the registration of our domain name
www.GotoDaddy.com.  As a matter of fact, I see that you have registered .net and .org extensions this year for the same domain name.  This is five years later after we registered our domain name.   

You must understand that there is no company in the world that has the right to take the word “daddy” as an exclusive to its own use.   Can you imagine if you claimed the right to every domain name that had the word daddy in it and made a demand for each of those registrants to cease and desist?  Can you imagine how many daddys would be stripped of their right to use the word, especially if the owner of your company Bob, is not a real daddy and he may be using the word for business, but nobody ever said it to him, like it was said to billions of other daddies by their kids.  So the wording, gotodaddy, is ours not yours, and you should have never registered the other extensions since we registered the .com extension of the domain name first. 

We have added the word not to our gotodaddy domain names in the same fashion as in the movie “Borat,” and when we received your email harassing us and flexing your muscles, we decided to put the domain name gotodaddynot.org to a good use.  You are welcome to go to www.gotodaddynot.org  

We would like you to be advised that we will not make any consideration regarding your request and we will fight you in court and with WPO to assert our rights and everyone else’s rights for the use of the word daddy to create a domain name, and your effort to have a monopoly and exclusive right to the word daddy is illegal, and defies logic and business practices.  We are also demanding from you and your advertisers to stop your bait and switch technique, and for once be honest regarding your advertised pricing.  What your company needs is not more domain names to be registered, but rather to secure your financial ability for those who have trusted you and registered and paid you for domain names for the next 10 years.

To date, our records indicate that you have not yet initiated the transfer to GoDaddy.com. as requested. Go Daddy takes the protection of our intellectual property very seriously and considers the domain name, GOTODADDYNOT.ORG, GOTODADDYNOT.NET, and GOTODADDYNOT.COM to infringe on one or more of our valuable trademarks.  
 
If you are having difficulty in transferring the domain name, please contact us immediately and we will be happy to assist with the process. Otherwise we hereby demand that you take the appropriate steps to cease all infringement of Go Daddy’s trademarks by November 20, 2007.
